Overview: Our web design services include designing, developing, and delivering websites for our clients. We require a deposit upfront for our services. The deposit covers our initial work on the project and is non-refundable.
Payment: We require a deposit of 50% of the total cost of the project upfront. The remaining 50% of the cost is due upon completion of the project. We accept payments through Payfast, or bank transfer. We will not begin work on the project until we receive the deposit.
Cancellation Policy: If you wish to cancel the project after we have started work, the deposit is non-refundable. However, if we have not started work on the project, we will refund the deposit in full. If you cancel the project after completion, you will still be responsible for paying the remaining 50% of the cost.
Revisions: We will work with you to ensure that you are satisfied with the website design. We provide three rounds of revisions for the design, and additional revisions will be charged at an hourly rate. If you wish to make significant changes to the project scope after we have started work, we reserve the right to charge additional fees.
Intellectual Property: All content on the website we design for you will belong to you, the client. However, we reserve the right to use the design elements we create for you in our portfolio or for marketing purposes. We will not use any of your proprietary information without your express written permission.
Warranties and Disclaimers: We warrant that we will use reasonable care and skill in our work on the project. However, we do not guarantee that the website will be error-free or uninterrupted. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.
Limitation of Liability: Our liability to you for any losses arising out of our services will not exceed the amount paid to us by you for those services. We will not be liable for any indirect, consequential, or punitive damages, including but not limited to lost profits or loss of business opportunity.
Governing Law and Jurisdiction: These terms and conditions will be governed by and construed in accordance with the laws of the Government. Any disputes arising out of or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts .
Deliverables: We will deliver the final product to you upon completion of the project. The final product will include the website design, content, and any related files or materials if you will be responsible for hosting the website on a web server.
Communication: We will communicate with you primarily through whatsapp and email. We will provide regular updates on the project's progress and seek your feedback and approval at key milestones.
Confidentiality: We will keep all information provided by you confidential and will not disclose it to third parties without your written permission. This includes information about your business, customers, and other sensitive information.
Termination: We reserve the right to terminate the project at any time if you breach these terms and conditions or fail to pay the remaining balance due on the project. If we terminate the project, you will not be entitled to a refund of the deposit.
Force Majeure: We will not be liable for any delay or failure to perform our obligations under these terms and conditions if such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or power outages.
